Welcome to the website of the St. Augustine Airport Pilots Association ("SAAPA," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, member portal, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
1. Acceptance of Terms
By creating an account, purchasing a membership, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. We reserve the right to update or modify these Terms at any time, and your continued use of the Services following any changes constitutes your acceptance of the revised Terms.
2. Membership Terms
SAAPA offers individual and family memberships on an annual basis. Membership benefits, dues amounts, and renewal dates are communicated at the time of enrollment and may be updated by the Board of Directors from time to time.
- Memberships run for a twelve-month period beginning on the date of enrollment or renewal.
- Members in good standing have access to member-only features of the website, including the member directory, classifieds, event registration, and other resources.
- Membership is non-transferable and is subject to compliance with these Terms and SAAPA's bylaws.
- The Board of Directors reserves the right to approve or deny membership applications at its discretion.
3. Account Responsibilities
When you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
- You must notify SAAPA immediately if you suspect any unauthorized use of your account or any other breach of security.
- SAAPA is not liable for any loss or damage arising from your failure to protect your account credentials.
- You may not share your account or allow others to access the Services using your credentials.
4. Payment and Refund Policy
Membership dues, event fees, and merchandise purchases are processed securely through Stripe, our third-party payment processor. By making a payment through the Services, you agree to Stripe's Terms of Service.
- All fees are stated in U.S. dollars and are due at the time of purchase or enrollment.
- Membership dues are generally non-refundable. In exceptional circumstances, refund requests may be submitted to the Treasurer at treasurer@saapaclub.com and will be considered on a case-by-case basis.
- Event registration fees may be refunded if a cancellation request is made at least seven (7) days before the scheduled event, unless otherwise stated in the event details.
- SAAPA does not store your full credit card information. All payment data is handled directly by Stripe in accordance with PCI-DSS standards.
5. User Content and Classifieds
The Services may allow members to post content, including classified advertisements, forum posts, photos, and other materials ("User Content"). By posting User Content, you agree to the following:
- You retain ownership of your User Content but grant SAAPA a non-exclusive, royalty-free license to display, reproduce, and distribute your User Content in connection with operating the Services.
- You represent that you own or have the necessary rights to post your User Content and that it does not infringe the intellectual property or other rights of any third party.
- Classified listings must be aviation-related or otherwise relevant to the SAAPA community. SAAPA reserves the right to remove any listing that is misleading, illegal, or otherwise inappropriate.
- SAAPA does not verify, endorse, or guarantee any classified listing. Transactions between buyers and sellers are solely between the parties involved. Use caution and good judgment.
- SAAPA reserves the right to remove any User Content at any time and for any reason, with or without notice.
6. Code of Conduct
SAAPA is committed to maintaining a respectful, safe, and welcoming community. When using the Services or participating in SAAPA activities, you agree to:
- Treat all members, guests, and community members with respect and courtesy.
- Refrain from posting or transmitting content that is defamatory, harassing, obscene, threatening, discriminatory, or otherwise objectionable.
- Not use the Services for any unlawful purpose or in violation of any applicable local, state, or federal laws.
- Not spam, solicit, or engage in unauthorized commercial activity through the Services.
- Promote aviation safety in all discussions and activities. Do not encourage or glorify reckless or unsafe flying practices.
- Report any violations of this code of conduct to the Board at info@saapaclub.com.
Violations of this code of conduct may result in a warning, suspension, or termination of your membership and access to the Services, at the sole discretion of the Board of Directors.
7. Intellectual Property
All content on the Services that is not User Content -- including but not limited to text, graphics, logos, the SAAPA name and branding, images, software, and design elements -- is the property of SAAPA or its licensors and is protected by copyright, trademark, and other intellectual property laws.
- You may not reproduce, distribute, modify, or create derivative works from any SAAPA content without prior written permission.
- The SAAPA name, logo, and associated marks are trademarks of the St. Augustine Airport Pilots Association. Unauthorized use is prohibited.
8. Disclaimers and Limitation of Liability
The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- SAAPA does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
- Any aviation-related information provided through the Services -- including safety tips, weather data, fuel prices, or educational materials -- is for informational purposes only and should not be used as a substitute for official FAA publications, NOTAMs, weather briefings, or professional flight instruction.
- In no event shall SAAPA, its officers, directors, volunteers, or members be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
- SAAPA's total aggregate liability for any claims arising from the Services shall not exceed the total amount of membership dues paid by you in the twelve (12) months preceding the claim.
9. Termination
SAAPA reserves the right to suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms or the code of conduct.
- Non-payment of membership dues or other fees.
- Conduct that is harmful to SAAPA, its members, or the aviation community.
- Request by law enforcement or government agencies.
Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination -- including intellectual property, disclaimers, limitations of liability, and governing law -- shall survive.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in St. Johns County, Florida, and you consent to the personal jurisdiction of such courts.
11. Changes to These Terms
SAAPA reserves the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where practicable, notify members via email or a notice on the website. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.
